Home Care Bill of Rights
RIGHTS AND RESPONSIBILITIES
WHAT YOU HAVE THE RIGHT FOR:
- To be informed of rights through effective means of communication (orally and in writing)
- To be given treatment without discrimination based on client's personal, cultural or ethic preference, disabilities or advance directives
- To be treated with respect, dignity and courtesy: for client, family and property
- To be free from neglect, financial exploitation, verbal physical and psychological abuse including humiliation, intimidation or punishment
- To upon request: client or authorized representative to be informed of full name, licensure status, staff position and employer of all persons with whom the client has contact and who is supplying, staffing or supervising care
- To be served by the agency staff that is properly trained and competent to perform their duties
- To live free from involuntary confinement and to be free from physical or chemical restraints
- To express complaints verbally or in writing about services or care that is or is not furnished or about lack or respect for you or your property by anyone who is furnishing services from ABC Home Health Care, Inc., and to exercise the right without fear of retribution, retaliation or discrimination
- To have all records, communications and personal information remain confidential
- To participate in planning care and services and receive instructions, education and changes regarding the plan of care
- To be informed in advance regarding care and changes in services to be furnished to enable client to give informed consent
- To refuse care with the confines of the law and to be informed of the consequences of such action
- To be involved on experimental research (ABC Home Health Care does not perform any experimental treatments)
- To participate in planning of the care plan and changes to the care plan including visits frequency of visit proposed
- To have information regarding Advanced Directives before care is provided and information related to Advanced Directives Policy of ABC Home Health Care, Inc.
- To be advised of extent which payment that will be provided by insurance and extent of payment required from client
- To be advised of any billing or payment changes as they occur during services rendered.
- To request written notice listing all individuals or legal entities having ownership and/or controlling interest in ABC Home Health Care, Inc.
- To have access to your care records through a written request
- To be informed of ABC Home Health Care, Inc., policy in regard client services
- To be able to suggest a new or reformed ABC Home health Care policy in relation to client services
- To be able, as outlined by State Regulations, if company is unable to meet client needs, to receive timely notice of transfer/discharge from ABC Home health Care, Inc.
- To revoke an Advanced Directives and/or DO NOT Resuscitate verbally or in writing at any time
- To contact the agency after hours at 719-543-2700. Staff is available by phone 24 hours a day for notification of cancellations or report complaints.
RESPONSIBILITIES
- To treat all healthcare workers, office personnel, and property with respect, dignity and courtesy
- To allow the healthcare worker to give treatment/assistance without discrimination as to race, color, religion, age, gender, sexual preference, national origin, handicap or medical needs.
- To complete and sign consents and releases
- To actively take part in the care plan and review it for updates, deletions of care instructions
- To make sure there is a safe and non-abusive environment in which care can be given
- To inform the company of any problems or dissatisfaction
- To inform the company of any pain status or situation that may negatively affect the condition of the patient
- To inform the company of any situations of dissatisfaction with patient care, to voice complaints or grievances at any time
- To keep all appointments, but when unable, to notify the ABC Home Health Care of such
- To provide the company a copy of advance directive, if one exists
- For supplying accurate and complete information about patient's present and past medical history, hospitalizations, medication, pain management and any other information that will assist in establishing an effective care plan
- For his/her actions if she/he chooses not to follow plan of care
- To notify ABC Home Health Care, Inc., if she/he does not understand the care plan or if care plan cannot be followed
- To give complete and accurate information for meeting financial commitments agreed upon with ABC Home Health Care, Inc.
You have been informed of your rights and responsibilities as stated above. If at any time you feel that you have not been accorded the respect and cooperation of the personnel of ABC Home Health Care or you feel your rights have been violated. Please feel free to call:

- If the conflict cannot be resolved, you may call the Colorado State Hotline number: 1-800-842-8826 or 303-692-2910 Monday-Friday from 7:30 a.m. - 4:00 p.m. This number is not a home health agency and there is no medical staff available. It is a resource only. The purpose of the hotline is to lodge complaints regarding care received or not received: including implementation of the advance directive requirements, or answer questions about local home healthcare agencies.
